Thank you for choosing Arkansas Digital as your Internet Service Provider. We hope to make your Internet experience a more pleasant one.
Introduction
Arkansas Digital's goal is to provide the fastest, easiest and most continuous service possible, at an affordable price. Arkansas Digital will diligently attempt to keep its systems upgraded with the newest technology and equipment available in order to provide useful and enjoyable services to all our Subscribers.
In order to maintain the quality of excellence we expect in the service we provide our Subscribers, Arkansas Digital has developed the following policy which spells out acceptable and unacceptable uses, along with restrictions and Subscriber responsibilities. The following RESPONSIBLE USAGE POLICY (RUP or Policy) should be read and interpreted in conjunction with the Arkansas Digital Internet Access Agreement (found on the Dial-up Account Request form.) Arkansas Digital is committed to and supports the free exchange of information and ideas over the Internet. Arkansas Digital does not actively monitor nor does Arkansas Digital exercise editorial control over the content of any web site, electronic mail, transmission, mailing list, news group or other material created or accessible over Arkansas Digital servers. However, Arkansas Digital reserves sole discretionary rights to cancel or suspend service and to remove any materials deemed potentially illegal, harmful to Arkansas
Digital business operations or equipment, or in violation of any part of this RUP or of the standard Arkansas Digital Internet Access Agreement.
I. Terms and Conditions
Arkansas Digital Internet Services may only be used for lawful purposes. Transmission of material in violation of federal or state regulations is prohibited. This includes, but is not limited to, copyrighted material legally judged to be threatening or material protected by trade secret. You agree to indemnify and hold harmless Arkansas Digital from any claims resulting from your conduct and/or use of the service which damages you or another party. Access to other networks or services connected directly or indirectly to Arkansas Digital must comply with the rules appropriate for those services, including the Use Policies established for Usenet and the Internet as a whole. Failure to observe and abide by these policies, or attempts to disrupt the Internet, may result in immediate termination of your account.
II. Billing Information and Charges
Activation Fees and the first month's service are payable in advance at the time the account is activated. You will be automatically billed on
the 1st of each month for that month. All payments are due at the time of
billing and considered late if not received in our office by the 15th of the month, at which time a late charge of $2.50 will be added to the account and a warning notice will be mailed. If full payment including the late charge is not received in our office, evidenced by post mark, within 5 days of receipt of the warning notice, the account will become in default and will be immediately deactivated. Deactivation of your account does not relieve your obligation to pay any past obligations or charges.
If your credit card charge or check is declined, then your account is in
default. Payments declined (NSF, over-limit, account closed, invalid account number, etc.) incur a $20 returned item fee. We will mail or email a 5-day warning letter to you. Payment in full, including the returned item fee and past due fees must be received in the Arkansas Digital office within 5 days of the warning letter. Service will not be resumed until all charges have been paid in full, including the reactivation fee. If you have received a 5-day notice you must mail your payment to:

All declined credit card payments and all fees, including reactivation fees must be mailed to the above address.
III. Subscriber Account Termination
As a Subscriber, you may request that your account be terminated at any time. Your request MUST be in writing and mailed to Arkansas Digital's
home office mailing address: 11 North Main Street, Greenwood, AR 72936; or faxed to 479-996-9444. This request must be received by the 25th of the month in order to avoid your being charged for the following month. Any prepaid setup charges are non-refundable. Any changes in billing information must be received by Arkansas Digital by the 25th of the month in order to take effect for the next billing cycle. A written request to terminate your service does not relieve your obligation to pay any past obligations or charges. If you wish to terminate your account and fail to submit account cancellation notice (in writing) by the 10th, you will still be liable for payment for services for the current month.
IV. Disclaimer of Liability
Arkansas Digital exercises no control whatsoever over the content of the information passing through its systems. Arkansas Digital makes no warranties of any kind whether expressed or implied for the service it is providing. Arkansas Digital also disclaims any warranty of fitness for a particular purpose. Arkansas Digital will not be responsible for any damage suffered from the direct or indirect use of its services. This includes loss of data resulting from delays, non-deliveries, mis-deliveries or service interruptions caused by its own negligence or errors or omissions. Use of any information obtained via Arkansas Digital is at your own risk. Arkansas Digital specifically denies any responsibility for accuracy or quality of information obtained through its services.
Arkansas Digital has no practical ability to restrict all conduct, communications or content which might violate this Policy prior to transmission on Arkansas Digital equipment or servers, nor can Arkansas
Digital ensure prompt removal of any such communications or content after transmission or posting. Therefore, in accordance and conjunction with and in addition to the disclaimer included in the Acceptable Usage Policy elsewhere on this website, Arkansas Digital disclaims all liability to Subscribers or others for any failure to enforce the terms of this Policy. Investigation and removal or modification of illegal, offensive, or otherwise inappropriate material or content is at the sole discretion of Arkansas
Digital.
V. Changes
Arkansas Digital reserves the right to change its account rates or services offered. By usage of Arkansas Digital Internet Access Service, Subscriber accepts and agrees to all Terms and Conditions set forth herein.
VI. Violations (Strictly Enforced)
The following actions are to be considered violations of Arkansas Digital policies:
- Using a personal account for high volume or commercial use. If
you would like to provide high-volume or commercial services, please contact Arkansas Digital for information about opening a commercial account. Activities which are prohibited as high volume include, but are not limited to exceeding 30MB of disk space for your email box. Any email box exceeding 30MB will have incoming mail bounced until the user removes email from the server.
- Using Arkansas Digital services for illegal purposes, or in support of illegal activities. Arkansas Digital reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. Activities which are prohibited as potentially illegal include, but are not limited to:
- Unauthorized copying or usage of copyrighted material including, but not limited to, digitization and distribution of
photographs from magazines, books, or other copyrighted sources, copyrighted software [including this Internet site], or any other legally protected information resource accessible through this Service.
- Exporting software or technical information in violation of U.S. export control laws.
- Ponzi schemes or pyramid or chain letters.
- Threatening bodily harm or property damage to individuals or groups.
- Making fraudulent offers of products, items, or services originating from your account.
- Attempting to unlawfully access the accounts of others, or
attempting to penetrate beyond security measures of our servers or other information systems whether or not the intrusion results in corruption or loss of data.
- Harassing others by sending unsolicited bulk e-mail (SPAM), "mail-bombing" or "news-bombing".
"Mail-bombing" constitutes sending more than ten (10) similar mail messages to the same email address. "News bombing" constitutes sending more than 10Mbytes of data to a
newsgroup. Using an Arkansas Digital server connection to send unsolicited bulk Email, 'mail bombs' or 'news bombs' through any other SMTP server is similarly prohibited. Violators are subject to immediate termination of service.
- Revealing your account password to others or allowing use of
your account by others (other than authorized users in your household). At no time can there be simultaneous use of the same user name and password combination.
- Logging onto the service from a phone number other than your primary or secondary access numbers.
- Forging any message header, in part or whole, of any electronic transmission, originating or passing through Arkansas Digital services.
- Distributing viruses and/or any other malicious programs to or from Arkansas Digital systems.
- Use of software or any device that would allow your account to stay logged on while you are not actively using Arkansas Digital services or use the account for the purpose of operating a server of any type.
- Cross-posting advertisements for products, items, or services to ten (10) or more unrelated USENET newsgroups.
- Posting articles to any USENET or other news group, mailing list or similar forum which are off-topic according to the charter or
other public statement of the forum.
- Disrupting any newsgroup with frivolous, excessively vulgar, or repetitious postings.
- Posting of binary, or excessively large, unrelated text files to non-binary news groups that have specifically requested such
material not be posted in the group's FAQ (Frequently Asked Questions).
- Unauthorized installation of "auto-responders", "cancel-bots" or similar automated or manual routines which
generate excessive amounts of net traffic, or disrupt net newsgroups or email use by others.
- Engaging in any of the above activities using the service of another provider while channeling such activities through an Arkansas
Digital account or re-mailer, or using an Arkansas Digital account as a mail drop for responses.
- Arkansas Digital defines "Unlimited Access" as the freedom to visit any website you choose. Arkansas Digital defines "Dedicated Access" as maintaining a constant connection without interruption for a period of time exceeding eight (8) hours. "Unlimited Access" Subscribers who are found to be attempting to use "Dedicated Access" are subject to immediate termination of service and will be billed for the usage according to the fees charged for Dedicated Access.
VII. Parental Control and Censorship
Arkansas Digital is aware of the concerns of parents in regards to what their children see on the Internet, so we have prepared this statement of position. Furthermore, we've included several useful links below for concerned parents.
Arkansas Digital does not allow illegal content on any web servers. Our servers are monitored closely, and any Arkansas Digital user or domain owner who posts any illegal content will be immediately disconnected. Anyone who attempts to use our network for illegal activities will be prosecuted to the fullest extent of the law, and Arkansas Digital cooperates fully with law enforcement agencies to assure compliance with legal guidelines.
Arkansas Digital is not in the censorship business. We believe this responsibility rests with the parents who subscribe to our service. In the interest of enabling concerned parents to learn more and make informed decisions about what is available to their children over their home computer, Arkansas Digital offers the links below to the major content control software vendors on the Internet.

VIII. Outages
Although our goal is to provide continuous uninterrupted service, outages, either scheduled or unscheduled do
happen. No matter how well equipped we are we have no way of predicting or controlling electrical outages that do occur periodically. From time to time Arkansas Digital will have to schedule a temporary shut down for maintenance and/or for equipment upgrades. In those cases you will be notified via email of the date and times for the interruption.
